1. Purpose
These General Terms and Conditions of Sale (“GTC”) govern the relationship between Harmonia Movendi Sàrl – Art & Mouvement Vermont (“AMV”) and the Client, regarding subscriptions to Brazilian Jiu‑Jitsu / Grappling classes and related disciplines, as well as access to the Academy’s facilities.

2. Services
AMV offers group classes, private and semi‑private classes in BJJ, Grappling and related disciplines.

3. Prices and Payment

  • Applicable prices appear in the official price list in force (VAT included).

  • Payment may be made in advance by bank transfer, card or cash.

  • For monthly plans, payment falls due on the 5th of each month for the current month. The first month is due upon contract signature.

  • Late payment: after formal notice, reminder fee CHF 20 and default interest 5% p.a. apply until full settlement. AMV may suspend access to classes until payment is regularised.

4. Term and Commitment
Subscriptions are available under the following options:

  • No fixed term: one‑time payment, valid 30 days.

  • Children: 5‑month commitment (payable monthly), 10‑month commitment (payable monthly) or semi‑annual (one‑time payment, valid 5 months).

  • Adults: 6‑month commitment (payable monthly), 12‑month commitment (payable monthly) or annual (one‑time payment, valid 12 months).

5. Suspension / Extension
Available only in case of accident, illness, pregnancy or military service, upon supporting document.
Maximum cumulative duration: 90 days per subscription year.
Written request at least 72 hours before the period concerned. Processing fee: CHF 20.
The subscription term is extended accordingly.

6. Termination
Early termination is permitted only in the event of force majeure duly evidenced (e.g. medical certificate, professional relocation outside the canton, military service).

  • 6/12‑month subscriptions: absent force majeure, the remaining balance is due until the contractual end date.

  • Annual (one‑time payment): pro‑rata refund of unused full months from receipt of a validated request, minus CHF 60 administrative fee.

7. Non‑payment
After two written reminders, the file may be transferred to the Debt Enforcement Office (Office des poursuites, LP/SchKG). The claim may be assigned to a third party (collection agency).

8. Changes to Prices and to the GTC

  • Prices: changes do not affect a contract already in force and apply upon renewal. Clients on month‑to‑month renewals are notified at least 30 days before any change.

  • GTC: AMV may update the GTC; the signed version applies until contract expiry. Updates are published on the website with their effective date.

9. Data Protection
Processing complies with the Swiss Federal Act on Data Protection (FADP/LPD) and, where applicable, the EU General Data Protection Regulation (GDPR). Personal data are used solely for administrative purposes.

Legal basis: performance of the contract / legitimate interest.
Retention: for the duration of the contractual relationship, then 36 months (except statutory accounting obligations: 10 years).
Processors: SportNow and the designated host/CRM.
Transfers outside CH/EU: none. If any occurred, they would be made only with adequate safeguards.
Rights: access, rectification, erasure (via the contact address).
Image rights: photos/videos may be taken during classes/events; any member may request their removal from AMV channels (website, social media) by contacting the management.

10. Code of Conduct / House Rules
The Client acknowledges having read and accepted AMV’s Charter of Conduct & House Rules (Charte de Vie & Règlement Intérieur: values, hygiene, safety, behaviour, sanctions).
To avoid duplication, detailed rules are set out in the Charter.

11. Use and Liability
Practice takes place under the Client’s own responsibility; personal accident insurance is mandatory. Access is refused in a state of intoxication or under the influence of substances.
For all other aspects (behaviour, hygiene, equipment, spaces), refer to the Charter.

13. Acceptance
By signing the subscription contract, the Client confirms having read, understood and accepted the GTC and the Charter.
If the Client is a minor, their legal representative confirms having read and accepted these documents and validly representing the child.

14. Severability
If any provision of the GTC is held null, invalid or unenforceable, the remaining provisions remain in force.

15. Non‑use
Non‑use of the services does not entitle the Client to any refund or reduction.

16. Closures and Schedule
AMV may adjust the schedule and appoint substitute instructors.
Official closures (public holidays, annual leave) do not entitle to a refund.
In the event of a closure exceeding 15 consecutive days, an equivalent extension is granted.

17. Governing Law and Venue
These GTC are governed by Swiss law. Courts of Geneva have jurisdiction, subject to mandatory places of jurisdiction provided by law.
